Mdp have substantial experience acting for both franchisors and franchisees across Australia. The Franchising industry has changed significantly in the past 10 years.

Franchising in Australia is governed by the Franchising Code of Conduct. From our experience, a successful franchise requires an understanding of the Franchising Code of Conduct and other regulatory requirements together with a strong working relationship between franchisors and franchisees.

Our lawyers have drafted many significant franchise agreements and the ancillary documents such as disclosure documents, leases and sub-leases. mdp works with franchisors to ensure that we protect your intellectual property. We have also advised many franchisors on the day to day issues including how to have a successful relationship with franchisees, which is critical to having a successful business.

We have also advised many franchisees and potential franchisees before purchasing a franchise. We have conducted due diligence and worked with accountants to ensure that the business will be robust. We have also advised franchisees on the day to day issues involved in being in a franchise relationship. We are well placed to advise franchisees, as we have significant experience in purchases of businesses, commercial and retail leases and employment contracts.

Further, in the unfortunate event that a franchise relationship sours, we are able to assist with our extensive experience in commercial dispute resolution.
